These terms govern your use of the Mara Colors website. The site is operated by Mara Colors Kenya Limited(“Mara Colors”, “we”, “us” or “our”). By using the site, you agree to these terms. If you do not agree, please stop using it.

You must be legally able to enter into these terms. A person using the site for a company or other organisation confirms that they have authority to act for it.

The website introduces the Mara Colors brand, products, shade families, inspiration and project-enquiry services. It is a discovery and enquiry platform; it does not currently provide online checkout or create a sale merely because you submit a form or message us.

A quotation, order confirmation, supply agreement or other written commercial document may contain additional terms. If there is a conflict concerning a specific purchase or project, the expressly agreed commercial document will apply to that transaction.

We take reasonable care to keep product names, pack sizes, finishes, palettes and intended uses clear. Website content is general marketing information and may be updated as products, technical specifications, stock and documentation develop.

Before purchasing or applying paint, confirm current availability, pack size, substrate compatibility, preparation, coverage, application method, drying and recoat times, maintenance guidance and safety information with Mara Colors. The current label, technical data sheet and safety data sheet take priority over a general website description.

Digital colors are indicative. Displays, brightness, photography, compression, surrounding finishes, surface texture and natural or artificial light can change how a shade appears. Always assess an approved physical sample in the intended space, at different times of day, before making a final color or application decision. See our Product & Color Disclaimer for more detail.

The Color Studio, room previews, L-shaped façade treatment, palettes, search and any coverage guidance are visual or planning aids. They do not reproduce an exact finished surface and do not replace a site assessment, measured calculation, current product documentation or advice from a qualified applicator or other relevant professional.

When you submit an enquiry, you confirm that the details are accurate and that we may use them to respond about your project or request. Response-time statements are aims, not guarantees. Our handling of personal data is explained in the Privacy Policy.

You may use the site only for lawful purposes. You must not:

• attempt to gain unauthorised access to the website, admin area, hosting, data or another user's systems;
• introduce malicious code, overload the service, scrape it at a disruptive scale or interfere with its operation;
• submit unlawful, misleading, abusive, infringing or fraudulent content; or
• falsely suggest that you, a product or a service is endorsed by or affiliated with Mara Colors.

We may restrict access or take protective action where we reasonably believe the site, our rights or another person is at risk.

Unless stated otherwise, the website design, Mara Colors name and marks, copy, product presentation, shade names, graphics, photographs and other original content are owned by or licensed to Mara Colors and protected by applicable intellectual-property law. You may view and share links to the site for personal or legitimate business consideration, but you may not reproduce, modify, publish, sell or use protected content commercially without written permission.

The site may link to WhatsApp, email, social media or other external services. We do not control their content, security, availability or privacy practices. A link is provided for convenience and does not by itself amount to endorsement. Review the third party's terms before using its service.

We may correct content, update products, change features, suspend access or withdraw all or part of the website without advance notice. We aim for useful and accurate content, but cannot promise that every page will always be complete, current, error-free or continuously available.

To the fullest extent permitted by law, website content and tools are provided on an “as available” basis without an implied guarantee that a digital color, estimate or general description will meet a particular project requirement.

Mara Colors is not responsible for indirect or consequential loss arising solely from reliance on general website content, third-party services or an indicative screen color. Nothing in these terms excludes or limits liability, rights or remedies that cannot lawfully be excluded under Kenyan law, including liability for fraud or wilful misconduct.

These terms are governed by the laws of Kenya. Subject to any mandatory consumer or statutory rights, disputes relating to the website will be submitted to the courts of competent jurisdiction in Kenya.
